Consider the costs before going to trial

When going through a divorce in Pensacola, FL, couples are faced with numerous choices throughout the process. One of the biggest choices is whether to work toward a divorce settlement or to go through with a trial. Before making the decision, people need to be aware of all the factors, including the costs of trial.

The first cost to be aware of is the financial one. Divorce trials can be expensive when factoring in the expenses of an attorney and court fees. This is not to say that spending the money is a waste if a court hearing is absolutely necessary.

There are also non-financial costs to consider. Trials are stressful and will certainly put a strain on a relationship. Some divorcing couples need to remain on amicable enough terms since they have children together. A court hearing reduces the chances that a couple will be able to move past the divorce on good terms.

However, there are times when there is no alternative but to go to trial. One spouse may be trying to play hardball or may be acting completely unreasonable in settlement talks. In that case, there could be little choice but to take the case in front of a judge so that the court can decide the matter.

Costs of a trial are generally considerable, but parties may have no other choice under certain facts. Nevertheless, the decision should not be taken lightly. A family law attorney might be of assistance if one spouse is completely unwilling to negotiate reasonably. They may help with negotiations or advise on strategies to help break an impasse. If a trial is necessary, the attorney may represent their client at trial and present the case to the court.
