Is The Risk Of Divorce Higher The Longer You Are Deployed?

Recent studies show that the risk of divorce for military spouses, increases with the amount of time that a spouse is deployed and away from home. Returning home after a long absence requires patience and understanding, at minimum. However, multiple deployments, physical and mental injuries or addiction to pain medications prove to be making the return to a normal life more difficult.

  • Soldiers injured on the battlefield are sometimes prescribed addictive pain killing drugs. Others, due to the trauma seen in battle struggle with mental health issues. Many of these soldiers, who served honorably for years, are then discharged from service with less than full military honor.
  • The increasing number of service discharges, less than “honorable” affect a veteran’s ability to find a job, medical care, housing assistance and the amount or even access to disability and pension funds. It almost goes without saying that placing a veteran in these financial and personal holes, often sets-up their family lives to fail.
  • When divorce happens, some of the benefits related to military service must be allocated between the spouses. In particular, a spouse’s right to half of a veteran’s retirement and pension benefits is determined by federal law.
  • Additionally, if a spouse is deployed and served with divorce papers, the law offers protections to prevent entry of an adverse judgment in some situations. The at-home spouse cannot take advantage of the deployed spouse’s inability to respond timely or properly.
