Divorce from an abusive spouse allows a fresh, safe start

A divorce can be one of the most emotional experiences anyone can have to endure. However, staying in a marriage in which domestic violence is present is much worse for a spouse than divorce. In the last five years, domestic violence issues have increased throughout Florida and elsewhere in the country.

Most people think that domestic violence is only physical, but it is not. Domestic violence can come in different forms, including control of resources and freedom restriction. When individuals decide to divorce their abusive spouses, one of the primary goals is their safety and that of their children. Some people find that restraining orders are effective, but there are limitations to what restraining orders can do, making complete removal from the situations the best course of action.

Once individuals are removed from an abusive situation, they may want to speak with an attorney. An attorney will ask a series of questions in regards to a spouse's fear, general safety and about the abusive behavior of the spouse. Once individuals truthfully answer these questions. the attorney will be able to advise on the first steps to take.

Individuals who have been victimized by domestic abuse should not feel embarrassed about revealing these issues. A national task force has been established through the American Academy of Matrimonial Lawyers. It is a collaborative effort that addresses domestic violence and educates officials, attorneys and judges about the implications.
