Agreements to provide financial support for child-raising are often contentious issues in the courts. Child support often boils down to what the parents can provide to keep a child living at the same level of comfort as if the parents were together. Courts commonly allow modification to such agreements if income levels change, but some parents may decide to include clauses that prevent such modification.
Warren Sapp, a famous football player formerly with Florida’s Tampa Bay Buccaneers, has asked the mother of one of his six children for a child-support deduction after encountering financial difficulties. But an added clause to his original child support agreement with the mother denies modification on these grounds.
It is believed Sapp expected his income to increase at the time he agreed to disallow modifications to his child support payment, wishing to keep the payments at the same $2,500 per month as determined when he was still playing in Florida. Now those same modifications may prevent him from receiving a deduction.
Sapp filed for Chapter 7 bankruptcy earlier this year, and he has also sought to make changes to other child support agreements with different women.
Modifications to child support obligations can include the possibility of reduced payments, and those seeking to change their existing agreement should strive to understand the many factors that affect family law and child support. Understanding the law is the first step toward reaching a fair conclusion.
