First Steps to Take After a Car Accident

While we don't like to think about the possibility of being in a car accident, it is important that we know what to do in case the event were to happen. After an accident, your heart might be racing but, try to stay calm. Take a deep breath and remember this mnemonic to help you through the next steps that you should take: ACT WISE.

A: ACCESS THE SCENE

Is everyone okay? Is anyone hurt? Is it safe to stay where the accident occurred? Do not leave the scene of the accident unless it is unsafe to stay.

C: CALLS FOR HELP

Call 9-1-1 if there is an injury. Do not move an injured person.

Call the local police so that a police report can be filed. Obtain the name and badge number of the officer taking the report.

Call your insurance company after a police report has been filed and let them know about the accident.

Call your attorney. Do not talk to anyone other than your attorney, the police and your insurance company about the accident. Do not admit fault or settle before talking to your attorney.

T: TAKE PHOTOS

Photos will help your insurance adjuster access the damage and photos can also serve as evidence is a claim is taken to court.

W: WITNESSES

Where there any witnesses? If so, ask witnesses what they saw and get their names and contact information.

I: INFORMATION from other parties

Be sure to get the names, addresses, phone numbers, driver's license numbers, license plate numbers, and makes and models of the cars involved.

S: SEEK MEDICAL ATTENTION

If you have any injuries or symptoms that may be related to the accident, seek medical attention.

E: ESTABLISH A FILE

Create a file that contains all documents related to the accident, including: police reports, photos, contact information of other parties and witnesses, medical records, etc. The more information you have the better.

After you have been through the ACT WISE steps, take the accident file that you established and meet with your attorney. Your attorney will help you resolve any issues/claims that resulted from your accident. Your attorney will help defend you if you were at fault or help maximize your recovery if you were the injured party.
