Individuals who have decided to split up with their spouses and move on with their lives may see nothing wrong with enjoying a few overnight dates with a new person. However, if one has children in the home, this person should be cautious in Florida. Not only can kids be emotionally affected by this, but the parent’s custody situation also could be impacted following a divorce.
To some people, allowing a date to spend the night while the kids are home is morally inappropriate. People have their own opinions on the matter and can easily debate whether this is right or wrong. More importantly, though, there are legal repercussions for doing this.
Letting someone stay overnight could actually jeopardize one’s chances of getting child support if this is revealed during the litigation process. This is because a divorce decree or agreement may feature a clause that says child support or alimony is linked to cohabitation. People who allow cohabitation to take place might also be in danger of losing their kids if they are the primary custodians.
Issues such as child support and alimony can be major sticking points during a divorce proceeding. If a married couple can come to an agreement on how to handle these matters, the court doesn’t have to get involved. Otherwise, a judge will have to decide the final outcomes for them. In addition, if child custody is being debated, the judge will consider the children’s best interests when making a decision. It is within the rights of both parents to pursue their own wishes during a divorce in Florida.
